We understand the legal context and negotiating skills required to work-out any bad debt situation on behalf of a borrower.

NAICCA has extensive experience assisting borrowers that do not have adequate operating income to service their debt loads. NAICCA can introduce new capital sources to deleverage single assets and portfolios while negotiating with lenders to reduce the borrower’s loan amount (and interest rates) so that borrowers can reset their assets to face this unparalleled downturn in this current real estate cycle. Our strength is addressing and solving complex real estate challenges by understanding our client's unique situation and utilizing a multidisciplinary approach to achieve a clear, concise and preferred result for the borrower. This expertise applies to all major property types, including office, industrial, retail, multi-family, hospitality, condo/co-op developments, master-planned communities and land development.

NAICCA can access and have direct relationships with servicers and lenders; most attorneys only deal with opposing legal counsel and never interact directly with a lender or servicer. This is a key benefit to a Borrower, putting the Borrower closer to the lender, where nothing is lost in translation. Since most of our compensation is success-based (with limited retainers), that means we must produce results in order to be compensated. The faster the result, the sooner NAICCA gets compensated. Others working on an hourly basis may prefer to drag out the process while NAICAA seeks ways to move the process quickly. Unlike other advisers, NAICCA uses the costly legal system as a negotiating tool to obtain better settlements for its clients. NAICCA is expert in reducing or showing methods to potentially assist in voiding Borrower’s personal guarantees. Often, it is a tough and difficult task to convince a lender to relinquish even valueless personal guarantees.
